Judge slams snatch theft’s inhumane act, jails man 13 years for leaving 71‑year‑old victim dying in Melaka drain

The High Court in Melaka sentenced Muhammad Faris Amjad Jamalludin, 27, to 13 years in prison for the death of Tan Kue Seng, 71, during a robbery in April 2023.

The judge condemned Faris for failing to assist the injured victim, highlighting the inhumane nature of his actions.

Faris and accomplice Noorbaizura Mohd Fuad, who was acquitted, had caused the victim to crash by kicking his motorcycle and subsequently stole his belongings.

Faris's sentence began from his arrest date on June 11, 2023.

MELAKA, Oct 9 — The High Court here today sentenced a man to 13 years in prison after finding him guilty of causing the death of an elderly man during a robbery in April 2023.

Judge Datuk D. Suria Kumar meted out the sentence to Muhammad Faris Amjad Jamalludin, 27, after taking into account the facts of the case and the mitigating factors presented by the defence.

He also reprimanded the accused for leaving Tan Kue Seng, 71, in a dying condition in a roadside drain along Jalan Gapam in Melaka Tengah on April 9, 2023, without seeking emergency assistance.

“Your actions were inhumane. I hope you repent and find honest work to support your family. The court views seriously offences involving snatch theft and robbery that result in injury or death to victims,” he said when passing sentence.

The judge also questioned the accused’s failure to call an ambulance for the victim.

“Imagine you were riding a motorcycle and were suddenly kicked. How would you feel? You would already be helpless, in the rain, at night and in the cold. The second accused probably had a phone too, but did not call for an ambulance,” he said.

He said the accused had kicked the victim’s motorcycle forcefully with his left foot, seemingly using that limb as a weapon to injure the victim before his death.

Meanwhile, Muhammad Faris Amjad’s friend, Noorbaizura Mohd Fuad, 37, the first accused in the case, was acquitted and discharged of the same charge.

According to the facts of the case, both accused, acting with common intention, kicked the victim’s motorcycle after seeing the elderly man riding alone.

The act caused the victim’s motorcycle to veer off the road shoulder before plunging into a concrete drain.

Muhammad Faris Amjad then took the victim’s waist bag and left him dying before using the victim’s bank card to make purchases.

The victim’s body was found by his son on April 11, 2023, swollen and emitting a foul smell, in the same drain.

Muhammad Faris Amjad was charged under Section 304(a) of the Penal Code (Act 574), read together with Section 34 of the same Code, which provides for a jail term of up to 30 years and a fine.

Deputy Public Prosecutor Muhammad Azfar Mahmod appeared for the prosecution, while Tiu Leong Kim represented Muhammad Faris Amjad and Mak Kah Keong represented Noorbaizura.

法官还质疑被告为何没有为受害者叫救护车。

“想象一下，你骑着摩托车，突然被人踢了一脚。你会是什么感觉？你当时肯定很无助，而且还是在雨夜里，天气又冷。第二名被告可能也有手机，但他没有叫救护车，”他说。

他说，被告用左脚用力踢了受害者的摩托车，似乎用这只脚作为武器伤害受害者，导致其死亡。

与此同时，穆罕默德·法里斯·阿姆贾德的朋友，37岁的努尔拜祖拉·穆罕默德·富阿德，作为该案的第一被告，被判无罪释放，免于同样的指控。

根据案件事实，两名被告人出于共同意图，看到老人独自骑车后，踢了受害者的摩托车。

这一行为导致受害者的摩托车偏离路肩，坠入混凝土排水沟。

穆罕默德·法里斯·阿姆贾德随后拿走了受害者的腰包，任由他奄奄一息，然后用受害者的银行卡进行消费。

2023 年 4 月 11 日，受害者的儿子在同一个排水沟里发现了受害者的尸体，尸体肿胀并散发出恶臭。

穆罕默德·法里斯·阿姆贾德被控违反《刑法典》（第 574 号法令）第 304(a) 条和该法典第 34 条，该条规定最高可判处 30 年监禁和罚款。
