Shahrir Samad and Tommy Thomas discussing possible resolution of civil suit

The High Court postponed proceedings in Tan Sri Shahrir Samad's civil suit against Tommy Thomas and others to allow settlement talks.

Shahrir's counsel reported positive developments in discussions with defendants, seeking a resolution before returning to court on 9th September.

In December 2023, Shahrir filed the suit alleging malicious prosecution related to a RM1 million cheque from Najib Razak for a housing project.

KUALA LUMPUR, Sept 7 — The High Court today adjourned proceedings in the civil suit filed by Tan Sri Shahrir Samad against former Attorney General Tan Sri Tommy Thomas, former Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Latheefa Koya, and two others, to facilitate settlement negotiations among the parties.

Judge Gan Techiong ordered the adjournment after Shahrir’s counsel Datuk Firoz Hussein Ahmad Jamaluddin informed the court that his client and the defendants were discussing a possible resolution of the matter.

“As we have indicated earlier, there have been some positive developments and discussions between the plaintiff and the second to fourth defendants. In that regard, we need to obtain further instructions from our client,” said Firoz Hussein.

“We seek Your Lordship’s leave and permission to discuss the matter, specifically the proposed resolution of the dispute. We also respectfully request that this morning’s proceedings be vacated to enable us to continue those discussions. We will return before Your Lordship on Wednesday (Sept 9),” he added.

Counsel Alan Adrian Gomez, representing Thomas as the first defendant, and senior federal counsel Zureen Elina Mohd Dom, appearing for the three other defendants, confirmed that the parties were engaged in settlement discussions and raised no objection to adjourning today’s proceedings.

Judge Gan then adjourned the proceedings to Sept 9 for the parties to update the court on the status of the proposed settlement.

Shahrir had been scheduled to continue giving his testimony in the matter today.

In December 2023, Shahrir filed the civil suit against Thomas, Latheefa, the MACC, and the Government of Malaysia, alleging malicious prosecution.

The former Johor Bahru Member of Parliament’s claim arises from a RM1 million cheque he had received from former Prime Minister Datuk Seri Najib Razak for rehabilitation works on the Puri Langkasuka housing project in Larkin, Johor.

Thomas, who served as Attorney General from June 2018 to February 2020, has denied Shahrir’s allegations against him, including abuse of power, describing them as “indefensible.”

He further clarified that he had resigned on Feb 28, 2020, and that Shahrir’s criminal trial commenced only on July 26, 2022.

On Jan 5, 2023, High Court Judge Datuk Muhammad Jamil Hussin acquitted Shahrir of the charge of failing to declare to the Inland Revenue Board the RM1 million in income received from Najib. — Bernama

沙赫里尔的律师拿督菲罗兹·侯赛因·艾哈迈德·贾马鲁丁向法庭表示，他的当事人和被告正在讨论解决此事的可能方案，之后，法官甘特雄下令休庭。

代表第一被告托马斯的律师艾伦·阿德里安·戈麦斯和代表其他三名被告的高级联邦律师祖琳·埃琳娜·穆罕默德·多姆证实，双方正在进行和解谈判，并且没有对延期今天的诉讼程序提出异议。

甘法官随后将庭审延期至9月9日，以便双方向法庭汇报拟议和解方案的进展情况。

沙赫里尔原定于今天继续就此事作证。
