‘Stare’ case at Kepong restaurant: AGC reviewing technician’s representation over grievous hurt charge

The Attorney General's Chambers is reviewing a technician's appeal against a charge of causing grievous hurt during a "stare" incident in Kepong in May.

The prosecution is awaiting psychiatric and forensic reports, crucial for the case of the accused, set for next mention on October 13.

Lawyers argue for reconsideration of the charge severity, claiming a lack of intent by accused Lai Kae Bin in the spontaneous incident.

KUALA LUMPUR, Sept 17 — The Attorney General’s Chambers (AGC) is still reviewing a representation by a technician seeking reconsideration of a charge of causing grievous hurt to a man in a “stare” incident at a restaurant in Kepong here in May.

Deputy Public Prosecutor Adiba Iman Hassan said the representation by second accused Lai Kae Bin was submitted on September 2 and is still under consideration.

“The prosecution seeks to have it recorded that documents related to the case have been handed over to the defence,” she said during the case mention before Sessions Court Judge Noor Aini Yusof here today.

On May 14, Lai, 33, carpenter Wong Weng Luen, 49, and memorial centre worker Wan Ken Fei, 30, pleaded not guilty to intentionally causing grievous hurt to Andrew Teh Tiek Hua, 49, at a restaurant in Jalan Kepong, Metro Prima, at 2am on May 7.

The charge under Section 326 of the Penal Code, read together with Section 34 of the same law, carries a maximum jail term of 20 years, and the offender may also be fined or caned upon conviction.

Adiba Iman said the prosecution was still awaiting Wong’s psychiatric assessment report, as well as a forensic report on closed-circuit television (CCTV) footage and full medical reports from private and government hospitals concerning the complainant.

Wong was not brought to court today as he is undergoing psychiatric assessment at Hospital Bahagia Ulu Kinta in Perak.

The court then fixed October 13 for the next case mention for the psychiatric report and submission of additional documents to the defence.

Lawyer Muhamad Firdaus Jumaludin, who represents Lai and Wong, told reporters after the proceedings that the representation was submitted seeking reconsideration of the Section 326 charge on the grounds that it was too serious.

“We (the defence) have examined the evidence in the case and do not see any intention on the part of (the second accused) to commit the act, as it happened spontaneously,” he said.

Lawyer Mohammad Arifin Abdul Wahab, who represents Wan, was also present during today’s proceedings.

根据《刑法》第 326 条和该法第 34 条的规定，该罪行最高可判处 20 年监禁，罪犯一经定罪还可被处以罚款或鞭刑。

阿迪巴·伊曼表示，检方仍在等待黄某的精神鉴定报告，以及闭路电视录像的法医报告和私立及公立医院关于投诉人的完整医疗报告。

黄某今天没有被带到法庭，因为他正在霹雳州乌鲁金塔巴哈吉亚医院接受精神鉴定。

法院随后将下次案件提审日期定为 10 月 13 日，届时将提交精神病学报告和辩方补充文件。

代表赖和黄的律师穆罕默德·菲尔道斯·朱马鲁丁在庭审结束后告诉记者，他们提交的陈述是要求重新考虑第 326 条的指控，理由是该指控过于严重。

他说：“我们（辩方）已经审查了案件中的证据，没有发现（第二被告）有任何实施该行为的意图，因为它是临时发生的。”

代表万的律师穆罕默德·阿里芬·阿卜杜勒·瓦哈卜也出席了今天的庭审。
