Albert Tei fails in bid to move five corruption charges to High Court

The Kuala Lumpur High Court dismissed Albert Tei Jiann Cheing's application to transfer his five corruption charges from the Sessions Court, stating the issues were not complex.

Tei faces charges under the MACC Act for allegedly bribing to secure mining licenses with bribes totaling RM140,000 and additional expensive items.

The offences occurred between November 2023 and September 2024.

The court emphasized that defendants can have time to prepare and reschedule proceedings if necessary.

KUALA LUMPUR, Sept 18 — The High Court today dismissed businessman Albert Tei’s application to transfer five corruption charges against him from the Sessions Court to the High Court.

Judge Noor Ruwena Md Nurdin dismissed the application by Tei, whose real name is Tei Jiann Cheing, 37, on the grounds that the issues raised were not complex and could be adequately dealt with in the Sessions Court.

“I do not agree with the applicant’s (Tei) application. My position is clear that the issues raised are not complex and would be faced by any accused person.

“Once you are brought before the court, you have time to appoint counsel and prepare yourself for trial. Even if a trial date has been fixed and you are still not ready, the court will grant latitude to postpone proceedings to ensure the accused is genuinely prepared,” the judge said.

Deputy Public Prosecutor Farah Ezlin Yusop Khan appeared for the prosecution, while lawyer Mahajoth Singh represented Tei.

In earlier proceedings, Mahajoth informed the court that the application was made because the charges faced by his client involved constitutional issues under the Malaysian Anti-Corruption Commission (MACC) Act.

Tei, 37, faces four charges of giving RM140,000 cash bribes, as well as furniture and electrical appliances worth RM14,580.03 and RM22,249, to the Prime Minister’s former senior political secretary, Datuk Seri Shamsul Iskandar Mohd Akin.

The bribes were allegedly inducements to secure Shamsul Iskandar’s assistance in helping companies linked to the accused obtain approval for mineral exploration licences in Sabah, although the matter had no connection to his principal’s affairs.

The offences were allegedly committed at a hotel car park in Jalan Sultan Hishamuddin, Jalan Medang Serai, Bukit Bandaraya, here, and in Precinct 14, Putrajaya, between November 24, 2023 and March 5, 2024.

Tei is also accused of giving RM64,924 in bribes to Shamsul Iskandar at a bank in Country Heights, Kajang, between November 28, 2023 and September 23, 2024.

All the charges are framed under Section 17(b) of the MACC Act 2009, which provides for a maximum jail term of 20 years and a fine of not less than five times the sum or value of the bribe, or RM10,000, whichever is higher, upon conviction. — Bernama

法官努尔·鲁韦纳·穆罕默德·努尔丁驳回了 37 岁的 Tei（真名 Tei Jiann Cheing）的申请，理由是提出的问题并不复杂，可以在地方法院得到充分处理。

“我不同意申请人（Tei）的申请。我的立场很明确，提出的问题并不复杂，任何被告都会面临这些问题。”

法官说：“一旦被带上法庭，你有时间指定律师并为庭审做好准备。即使庭审日期已经确定，而你仍未做好准备，法庭也会酌情延期审理，以确保被告真正做好准备。”

副检察官法拉·埃兹林·尤索普·汗代表控方出庭，而律师马哈乔特·辛格代表泰伊出庭。

在之前的诉讼程序中，马哈乔特告知法庭，提出该申请是因为他的当事人面临的指控涉及马来西亚反贪污委员会（MACC）法令下的宪法问题。

37岁的郑某面临四项指控，罪名是向首相前高级政治秘书拿督斯里沙姆斯·伊斯坎达尔·莫哈末·阿金行贿14万令吉现金，以及价值14580.03令吉和22249令吉的家具和电器。

据称，这些贿赂是为了诱使沙姆斯·伊斯坎达尔协助与被告有关联的公司在沙巴获得矿产勘探许可证，尽管此事与他的委托人的事务无关。

据称，这些罪行是于2023年11月24日至2024年3月5日期间在Jalan Sultan Hishamuddin、Jalan Medang Serai、Bukit Bandaraya以及布城第14区的一个酒店停车场犯下的。
