Frozen assets may hinder RM50m payment for Najib’s house arrest, his lawyers say

Former Malaysian Prime Minister Datuk Seri Najib Razak's capacity to pay a RM50 million fine for house arrest is hindered by ongoing government enforcement proceedings involving his frozen assets.

His legal team has indicated that much of his wealth remains beyond his control due to these legal constraints, thus impacting the fulfillment of the fine requirement.

Najib continues his current incarceration at Kajang Prison until the financial conditions for his house arrest, granted by a conditional pardon, are met.

Expressing gratitude for the support, Najib and his lawyers thanked the Federal Territories Pardons Board and political allies involved in facilitating his conditional release.

KUALA LUMPUR, Sept 20 — Former prime minister Datuk Seri Najib Razak’s ability to pay the RM50 million fine required for his house arrest could be complicated by frozen assets, bank accounts and properties subject to government enforcement proceedings, according to his lawyers.

The legal firm Messrs Shafee & Co said a “significant part” of Najib’s assets remained subject to freezing orders and enforcement proceedings, meaning their disposal was not presently within his sole control.

“His ability to satisfy the condition therefore turns in part on matters that do not lie in his own hands,” the lawyers said in a statement issued on Najib’s behalf.

Najib remains at Kajang Prison in the meantime and will only be transferred to house arrest once the conditions are satisfied, the lawyers added.

Attorney General Tan Sri Mohd Dusuki Mokhtar said yesterday that Najib must first pay the RM50 million fine at the Kuala Lumpur High Court Registrar’s Office before the house-arrest process can proceed.

The Federal Territories Pardons Board granted Najib a conditional pardon on Friday, allowing him to serve the remainder of his sentence under house arrest until Aug 23, 2028, subject to the payment and other conditions.

Najib’s lawyers also thanked the King and the Federal Territories Pardons Board for the decision, while Najib expressed gratitude to Deputy Prime Minister and Umno president Datuk Seri Ahmad Zahid Hamidi, the Umno supreme council and the party and Barisan Nasional leadership and members for their support.

Najib has been serving a six-year sentence at Kajang Prison since August 2022 after the Federal Court upheld his conviction in the SRC International case; his original 12-year sentence and RM210 million fine were reduced to six years and RM50 million respectively following a 2024 pardon.

联邦直辖区赦免委员会于周五给予纳吉有条件赦免，允许他居家监禁至 2028 年 8 月 23 日，但需支付罚款并满足其他条件。

纳吉的律师也感谢国王和联邦直辖区赦免委员会的决定，而纳吉则对副首相兼巫统主席拿督斯里阿末扎希哈米迪、巫统最高理事会以及该党和国阵的领导层和成员表示感谢，感谢他们的支持。

纳吉自 2022 年 8 月以来一直在加影监狱服刑，刑期为六年。此前，联邦法院维持了他在 SRC 国际公司案中的定罪；他最初的 12 年刑期和 2.1 亿令吉罚款在 2024 年获得赦免后分别减至 6 年刑期和 5000 万令吉。
