Jail, caning for stepfather who sexually assaulted 16-year-old stepdaughter

SINGAPORE – A man sexually assaulted his 16-year-old stepdaughter under the pretext of teaching her about sexual education.

A month later, he asked her to shower with him.

The 37-year-old man was sentenced to 20 months and 10 days’ jail and three strokes of the cane on Sept 25.

The man, who cannot be identified due to a gag order to protect the identity of the victim, has appealed against his sentence.

According to court documents, the girl had lived with her mother and her stepfather in a housing board flat in Canberra since she was 12 years old.

She said the accused initially acted as a “middleman” in the household, stepping in to mediate whenever she argued with her mother.

Over time, the arguments escalated and involved the three of them.

In September 2022, shortly before the offences occurred, the victim’s relationship with her mother and stepfather had improved. They quarrelled less, and communicated with one another “like friends”, according to the court documents.

On Sept 9, 2022, the girl entered the bedroom and asked her stepfather for money to buy food. According to her, the man was topless and his lower body was covered with a blanket.

As she was about to leave the room, the man asked her if she had watched pornography, and how physically intimate she had been with her ex-boyfriend.

The girl said she hugged and kissed her ex-boyfriend, who would put his hand on her thigh when they were in the cinema.

The stepfather placed his hand on her bare thigh and asked, “Is it like this?” He then took her hand and guided it in the direction of his private parts, but the girl pulled her hand away.

The man then told his stepdaughter that he was trying to “teach” her sexual education, which the girl found strange.

He also asked her for a hug, and to lie down on the bed.

As she did so, the girl heard the blanket being drawn over her as the man lay down beside her. She closed her eyes as she was too afraid to look.

He reached over and pulled her right leg over his body.

At that point, the victim felt something touching her near the inner thigh. The man then hugged her and said, “Thank you for being my daughter, I’m sorry.”

Subsequently, they sat up and the man told the girl not to speak to anyone about the incident.

Before the girl left the room, he asked her for another hug, but told her to face the door.

The girl recorded a diary entry on her phone that same day.

On Oct 9, 2022, the man texted the girl, saying he needed help checking a bruise on his body. The girl suggested that he use his phone or a mirror, but he refused.

The girl grew suspicious of his intention. After she told him to wait for her mother to return, the man asked if she had showered.

When the girl said no, he asked: “Do you want to shower with me?” He explained that this was what a father-daughter relationship was like.

The girl refused and left the bedroom. She recorded a diary entry on her phone that same day and confided in her mother, saying she wanted an apology from her stepfather.

She added that she would lodge a police report if he did not apologise.

However, the girl was berated by her mother, who accused her of seducing her stepfather.

The next day , the girl decided not to sit for her additional mathematics examination, as she was unsettled by the confrontation with her mother.

Deputy Public Prosecutor Adelle Tai said the girl’s account of the events was credible, given that her testimony in court was corroborated by her diary entries after the incidents.

Her accounts of both incidents were also consistent with her police statements and her disclosure to the school counsellor.

The counsellor had testified during the trial that the girl was “in tears” when she recounted the incidents.

During the trial, the man claimed his stepdaughter had fabricated the allegations to skip her additional mathematics exam and move to her grandmother’s house to escape parental supervision.

He also claimed that the victim hated him, court documents stated.

However, the prosecutor argued that both reasons were untenable, as the girl only made the decision to skip the exam after feeling exhausted from the confrontation.

On the man’s claim that the girl had fabricated the allegations to escape living with her parents, Tai pointed out that the allegations emerged when their relationship was improving.

“If the victim had wanted to fabricate allegations badly enough to risk perjury, she had ample opportunity to do so in the years prior, when the relationship was at its worst,” she said.

“The victim came forward knowing she risked disbelief. She was right. Her own mother did not believe her... She instead berated the victim for seducing the accused, persuaded her to withdraw the allegations against the accused and eventually testified against the victim.

“Yet, the victim stood firm. In her words, ‘I am upholding my justice.’ She asked for nothing more than an apology. When that was denied, she told the truth anyway.”

当她即将离开房间时，那名男子问她是否看过色情片，以及她和前男友在身体上有多亲密。

女孩说，她拥抱亲吻了前男友，两人在电影院时，前男友还会把手放在她的大腿上。

继父把手放在她裸露的大腿上，问道：“是这样吗？”然后他抓住她的手，引导她把手伸向自己的私处，但女孩把手抽了回去。

然后，这名男子告诉他的继女，他正在试图“教”她性教育，这让女孩觉得很奇怪。

他还请求她拥抱一下，并让她躺在床上。

就在这时，女孩听到毯子盖在她身上，男人躺在她身边。她害怕得闭上了眼睛。

他伸手将她的右腿拉到自己身上。

这时，受害者感觉大腿内侧附近有什么东西在碰她。随后，那名男子抱住了她，说道：“谢谢你做我的女儿，对不起。”

随后，他们坐了起来，男人告诉女孩不要把这件事告诉任何人。

女孩离开房间前，他又向她要了一个拥抱，但让她面向门口。

当天，女孩在手机上写下了一篇日记。

2022年10月9日，该男子发短信给女孩，说他需要帮忙查看身上的瘀伤。女孩建议他用手机或镜子查看，但他拒绝了。

女孩开始怀疑他的意图。在她让他等她母亲回来后，男人问她是否洗过澡。

女孩拒绝后，他问：“你想和我一起洗澡吗？”他解释说，这就是父女关系。

女孩拒绝了，离开了卧室。当天，她在手机上写了一篇日记，并向母亲倾诉，说她想要继父的道歉。

她还表示，如果他不道歉，她将向警方报案。

然而，女孩却遭到母亲的责骂，母亲指责她勾引继父。

第二天，女孩因为和母亲的冲突而心神不宁，决定不参加附加数学考试。

副检察官阿黛尔·泰表示，鉴于女孩在法庭上的证词与事发后的日记内容相符，因此女孩对事件的描述是可信的。

她对这两起事件的描述也与她向警方的陈述以及她向学校辅导员的披露一致。

辅导员在庭审中作证说，女孩在讲述事件经过时“泪流满面”。

庭审期间，该男子声称他的继女捏造了这些指控，目的是为了逃避额外的数学考试，并搬到祖母家以躲避父母的监管。

法庭文件显示，他还声称受害者恨他。

然而，检察官辩称这两个理由都站不住脚，因为女孩是在与人发生冲突后感到精疲力竭才决定放弃考试的。

针对该男子声称女孩捏造指控以逃避与父母同住的说法，Tai 指出，这些指控是在他们关系好转时出现的。

“如果受害者真的想捏造指控到愿意冒着作伪证的风险，那么在之前几年，也就是双方关系最糟糕的时候，她有很多机会这样做，”她说。

“受害者明知自己可能不被相信，但还是挺身而出。她的预感是对的。就连她自己的母亲都不相信她……反而斥责受害者勾引被告，劝说她撤回对被告的指控，最终还出庭作证指控受害者。”

“然而，受害者立场坚定。她说：‘我是在维护我的正义。’她只要求对方道歉。当道歉被拒绝后，她还是说出了真相。”
