Attorney General Letitia James takes over Cornell investigation as new details emerge

New York State Attorney General Letitia James will be taking over as special prosecutor in the case alleging sexual assault at Cornell University, Gov. Kathy Hochul announced Thursday evening, saying she “lost faith” in the district attorney’s ability to oversee it.

The announcement comes as new details have emerged this week about the alleged gang rape of then-student Jane Doe in a room at the Chi Phi fraternity house in 2024, including what she told campus police about the alleged assault.

James will now have the power to investigate the incident and, if warranted, prosecute any offenses and present evidence to a grand jury.

Cornell told CNN Thursday it supports the governor’s decision.

Tompkins County District Attorney Matthew Van Houten has repeatedly told CNN that his office never received more than the Snapchat messages and a six-page investigative report before deciding not to bring charges in the case.

Cornell University has agreed to an outside investigation of its handling of sexual assault allegations made by a student in 2024 against several fraternity members, New York Governor Kathy Hochul said Wednesday.

Hochul said she has directed her office to look into possible steps to take when the legislature convenes in January 2027.

Sexual assault survivors and advocates have long criticized a “loophole” in New York’s law that can make it nearly impossible for survivors to seek justice if they voluntarily consumed alcohol or drugs before an assault, but efforts to remove it have so far been unsuccessful.
