Two men were each slapped with a fine of over $3.3 million on Tuesday (Oct 6) after cooking up a scheme to import cheaper diesel into Singapore without paying tax.

Chua E Hong, 51, and Ng Leok Kwee, 48, each admitted to three charges of fraudulently evading duty of more than $905,000 on the importation of more than 4.5 million litres of automotive diesel oil between April and December 2024.

Chua was the managing director and Ng was the executive director of both CNC Petroleum Pte Ltd and PS Energy Pte Ltd, sister companies under the PS Energy Group, when they committed the crime.

Another 16 charges for fraudulent evasion of duty and fraudulent evasion of GST, involving more than $2.5 million in uncollected tax, were taken into consideration when the Singaporeans were sentenced at the State Courts on Tuesday.

Singapore Customs said Chua and Ng had sourced cheaper diesel from Malaysia without declaring its importation or obtaining the necessary permits.

Based on a tip-off, the agency investigated the scheme and found that the diesel was resold to customers in Singapore to increase profits of CNC Petroleum.

The diesel was purchased by CNC from suppliers' terminals in Pengerang, Johor, and transported into Singapore's territorial waters by a vessel coordinated by Ng.

On multiple occasions, the diesel was transferred at Selat Pauh Petroleum Anchorage in Singapore waters to two smaller vessels and subsequently transported to Penjuru Terminal.

At the terminal, the diesel was transported to tanker trucks for distribution to Singapore customers.

The scheduling of the vessels and tanker trucks, as well as the collection and transfer of the diesel, was handled by Ng.

Under the Customs Act, a person convicted of fraudulently evading duty or GST may be fined up to 20 times the amount of duty and GST evaded and jailed for up to 12 months.
