Malaysia to proceed with repatriation of 5,000 Myanmar refugees after court ruling, says home minister

PUTRAJAYA, Oct 29 — The government will continue efforts to repatriate Myanmar refugees to their country of origin through lawful channels and established diplomatic processes, Home Minister Datuk Seri Saifuddin Nasution Ismail said.

He said the repatriation efforts would proceed in line with the court’s decision to dismiss the Malaysian Bar’s application for a stay.

Saifuddin Nasution said the Home Ministry and the Foreign Ministry would continue negotiations with the Myanmar government to facilitate the repatriation of the second group, unless the court ruled otherwise.

“Let the legal process determine the outcome. Until there is a decision to the contrary, we will continue with the repatriation.

“For now, the Malaysian Bar’s application for a stay has been dismissed, so we will proceed. The judicial review has been fixed for Dec 8,” he said in his speech at the Home Ministry’s monthly assembly and Innovation Day celebration here today.

Media reports said the High Court had dismissed the Malaysian Bar’s application to temporarily halt the repatriation of about 5,000 Myanmar refugees and asylum seekers, ruling that a stay could not be granted before leave for judicial review was given.

Judge Norliza Othman said the dismissal did not affect the Malaysian Bar’s right to renew its application after the court had decided whether to grant leave for judicial review.

Meanwhile, Saifuddin Nasution urged the public not to take matters into their own hands over the presence of Myanmar refugees, stressing that enforcement should be left entirely to the authorities.

He acknowledged that refugee issues could give rise to various socioeconomic problems, but said the public should not go to extremes or act beyond the law.

“Their arrival has caused economic, political and social problems in certain communities, prompting some members of the public to take matters into their own hands, such as attacking their homes or forcing them out of their villages.

“The police are carrying out their duties and are urging the public not to take the law into their own hands. Leave it to the authorities and immigration enforcement agencies, which are conducting continuous operations,” he said.

Yesterday, Prime Minister Datuk Seri Anwar Ibrahim said Malaysia had opted for a diplomatic approach with Myanmar to address the refugee issue, despite facing international condemnation and criticism over the government’s stance.

He said that following discussions with the Myanmar authorities, the country had agreed to repatriate some of its nationals in Malaysia at its own expense, including by air and sea.

To date, about 10,300 Myanmar nationals have been repatriated, while another 3,000 are expected to undergo the repatriation process this month. — Bernama

他表示，遣返工作将按照法院驳回马来西亚律师公会暂缓执行申请的决定进行。

赛夫丁·纳苏蒂安表示，除非法院另有裁决，否则内政部和外交部将继续与缅甸政府进行谈判，以促成第二批人员的遣返。

“让法律程序来决定结果。在有相反的决定之前，我们将继续进行遣返工作。”

“目前，马来西亚律师公会提出的暂缓执行申请已被驳回，因此我们将继续推进。司法审查已定于12月8日进行，”他在今天于此举行的内政部月度大会暨创新日庆祝活动上发表讲话时说道。

媒体报道称，高等法院驳回了马来西亚律师公会提出的暂时中止遣返约 5000 名缅甸难民和寻求庇护者的申请，裁定在获得司法审查许可之前，不能批准中止遣返。

诺丽扎·奥斯曼法官表示，驳回申请并不影响马来西亚律师公会再次提出申请的权利，法院已决定是否准予司法审查。

与此同时，赛夫丁·纳苏蒂安敦促公众不要自行处理缅甸难民问题，强调执法应完全由当局负责。

他承认难民问题可能会引发各种社会经济问题，但他表示公众不应走极端或违法行事。

“他们的到来给某些社区带来了经济、政治和社会问题，促使一些民众自行采取行动，例如袭击他们的房屋或强迫他们离开村庄。

他说：“警方正在履行职责，并呼吁公众不要以暴制暴。请将此事交给当局和移民执法机构处理，他们正在持续开展行动。”

昨天，马来西亚总理拿督斯里安华·易卜拉欣表示，尽管马来西亚政府的立场面临国际社会的谴责和批评，但马来西亚仍选择以外交手段与缅甸解决难民问题。

他表示，经过与缅甸当局的磋商，缅甸已同意自费将部分在马来西亚的缅甸国民遣返回国，包括通过空运和海运。
