AGC appeals against State Court’s decisions in case of man who assaulted private-hire driver

SINGAPORE - The Attorney-General’s Chambers (AGC) said on Sept 9 it has filed appeals against the State Courts’ decisions on the case involving a British man who assaulted a private-hire driver who later died.

The first appeal , which the AGC filed on July 27, concerns the District Judge’s decision to amend the charge of voluntarily causing hurt to one of assault.

The second appeal is on the sentence imposed, which the AGC said was “manifestly inadequate”. It was filed on Sept 8.

On Sept 7, British national Oruche Morgan Fidelis, 23, was sentenced to a five-day short detention order (SDO) and 100 hours of community service.

Fidelis had claimed trial to a charge of voluntarily causing hurt, but the District Judge on July 15 had amended the charge to one of assault and convicted Fidelis under the amended charge, said the AGC.

The 66-year-old driver, Low Ek Yong, was found with a fractured skull and a brain injury.

Low died of other causes – heart disease and large bowel obstruction – a year later.

AGC 于 7 月 27 日提起的第一项上诉，涉及地区法官将故意伤害罪的指控改为袭击罪的决定。

第二次上诉针对的是判决结果，总检察署称该判决“明显过轻”。该上诉于9月8日提出。

菲德利斯否认了故意伤害罪的指控，但地方法官于 7 月 15 日将指控改为袭击罪，并根据修改后的指控判菲德利斯有罪，总检察长办公室表示。

66岁的司机刘益勇被发现颅骨骨折，并有脑损伤。

一年后，洛因其他原因去世——心脏病和大肠梗阻。
