Former Tabung Haji COO Adi Azuan charged with receiving RM302,000 in house renovations

Former Lembaga Tabung Haji chief operating officer Datuk Adi Azuan Abdul Ghani pleaded not guilty to three counts of graft involving over RM302,000 in home renovation works.

The charges, which relate to his acceptance of gratuities from AG Reka Sdn Bhd's director, were framed under Section 165 of the Penal Code.

The court set a bail at RM50,000 with two sureties and ordered Adi Azuan to surrender his passport, with the case scheduled for mention on November 25.

The proceedings, initially planned for September 3, were postponed due to his hospitalization for an angiogram.

SHAH ALAM, Sept 24 — Former Lembaga Tabung Haji (TH) chief operating officer Datuk Adi Azuan Abdul Ghani pleaded not guilty at the Sessions Court here today to three counts of graft involving over RM302,000 in home renovation works.

Adi Azuan, 56, claimed trial to all charges after they were read out before Sessions Court Judge Awang Kerisnada Awang Mahmud, The Star reported.

According to the charge sheets, Adi Azuan, in his capacity as TH chief operating officer, allegedly accepted gratification for himself in the form of renovation expenses amounting to RM235,866.58, RM50,698.74, and RM15,933.95 for three residential properties at different locations.

He is accused of receiving the works from AG Reka Sdn Bhd director Thamsulazri Ismail, an individual whom the accused knew had official connections with his public duties at the pilgrimage fund.

The offences were allegedly committed on March 7, 2017, at the three properties located in Shah Alam, Kota Damansara, and USJ 2, Subang Jaya.

The charges were framed under Section 165 of the Penal Code, which provides for a maximum prison sentence of two years, a fine, or both, upon conviction.

Deputy Public Prosecutor Muaz Ahmad Khairuddin informed the court that the offences were non-bailable, but proposed bail at RM70,000 with one surety should the court exercise its discretion to grant temporary release.

“We leave it to the court’s discretion if it decides to impose additional bail conditions,” Muaz said.

In mitigation, defence counsel Wan Azwan Aiman Wan Fakhruddin appealed for a lower bail sum of RM30,000, stating that his client is the sole provider for four sons aged between 12 and 25 who are still studying, including his eldest who is currently in university. The lawyer also requested that the court not impound Adi Azuan’s passport, contending that he poses no flight risk.

Awang Kerisnada fixed bail at RM50,000 with two sureties and ordered the accused to surrender his passport to the custody of the court.

“If he needs to use his passport, he can write to the court,” Awang Kerisnada said.

The court scheduled the case for mention on Nov 25.

Adi Azuan was originally slated to be charged on Sept 3, but the proceedings were adjourned after he was admitted to hospital to undergo an angiogram procedure.

莎阿南，9月24日讯——前朝圣基金局（TH）首席运营官拿督阿迪·阿祖安·阿卜杜勒·加尼今日在莎阿南地方法庭对三项贪污指控拒不不认罪，这些指控涉及房屋装修工程中超过30.2万令吉的贪污款项。

据《星报》报道，56岁的阿迪·阿祖安在地方法院法官阿旺·克里斯纳达·阿旺·马哈茂德面前被宣读了所有指控后，否认了所有指控。

根据控状，Adi Azuan 作为 TH 的首席运营官，涉嫌收受贿赂，以装修费用的形式为自己支付了位于不同地点的三处住宅物业的装修费用，金额分别为 235,866.58 令吉、50,698.74 令吉和 15,933.95 令吉。

他被指控从 AG Reka Sdn Bhd 董事 Thamsulazri Ismail 那里收受作品，而被告明知 Thamsulazri Ismail 与他在朝圣基金的公职有官方联系。

据称，这些罪行发生在 2017 年 3 月 7 日，地点位于莎阿南、哥打白沙罗和梳邦再也 USJ 2 的三处房产。

这些指控是根据《刑法》第 165 条提出的，该条规定，一经定罪，最高可判处两年监禁、罚款或两者并罚。

副检察官穆阿兹·艾哈迈德·凯鲁丁告知法庭，这些罪行不可保释，但如果法庭行使自由裁量权给予临时释放，他建议以 70,000 令吉的保释金和一名担保人保释。

穆阿兹说：“是否附加保释条件，由法院酌情决定。”

辩护律师万·阿兹万·艾曼·万·法赫鲁丁（Wan Azwan Aiman Wan Fakhruddin）请求法庭将保释金降低至3万令吉，并指出其当事人是四个儿子的唯一经济支柱，这些儿子年龄介于12岁至25岁之间，且均在求学，其中长子目前正在上大学。律师还请求法庭不要扣押阿迪·阿祖安（Adi Azuan）的护照，认为他没有潜逃风险。

阿旺·克里斯纳达法官裁定被告以5万令吉的保释金保释，并要求两名担保人，同时命令被告将护照交由法庭保管。

“如果他需要使用护照，他可以写信给法院，”阿旺·克里斯纳达说。

法院安排该案于11月25日进行庭审。

阿迪·阿祖安原定于 9 月 3 日被起诉，但由于他入院接受血管造影手术，庭审被推迟。
